This Agreement is made between Granite Masters Corporation INC, an Indiana with its principal place of business at 861 Hart Farm Road, Schererville, Indiana, USA, 46375 (hereinafter "Seller"), and the purchaser identified on the face of this invoice (hereinafter "Buyer").
This is Agreement for the merchandise and service printed below. The final price may be changed, depending on site measurements. This becomes an Agreement upon 50% down payment (refundable, 10% processing fee. Non-refundable if the material is already cut).
Terms: 50% DOWN, 50% - JOB COMPLETED, TO BE PAID TO INSTALLERS, ALL OUT OF STATE PROJECTS BALANCE DUE PRIOR INSTALLATION DATE.
BASIC INSTALLATION AND LABOR INCLUDES:
Measurement is done after the cabinets are set & leveled (customer's responsibility), old counter top removed, the sink, cook top, or any cut out item must be on the site at the time of measurement or an additional trip charge will apply. All measurements shall be as exact as possible; however, the Buyer agrees to accept variations in measurement if the old countertop is not removed at or before the measurement. Customer agrees not to move any cabinets (kitchen, island, vanities, etc), after the measurement. Customer is responsible for any and all additional charges as the result of moving once measured cabinets.
Standard price includes: polished straight / radius edge, 4" backsplash with 1-1/4" thickness, installing new counter tops, self rimming, drilling for one faucet, 2 holes' cutout (one undermount sink opening), securing new tops to cabinets, installing backsplashes, caulking backsplash to countertop only, filling seams. It is the customer's responsibility to arrange for removal and replacement of sinks, faucets, cooktops, countertops, unless otherwise specified. Granite Masters does not guarantee the number of seams on counter top and backsplashes, or to match exact color pattern in the seam areas. However, Granite Masters will try to minimize the seam numbers and to match the color pattern as best as possible, subject but not limited to a slab size, countertop size and shape, kitchen position in the house or condominium, etc.
UNLESS STATED ABOVE THIS INSTALLATION DOES NOT INCLUDE:
Relocating any plumbing or electrical supply, repairing / rebuilding existing cabinetry, repair of plumbing, repairing walls, tiles, drywall or plaster (including painting), before or after the installation, cleaning dust after installation, moving in and out stove, refrigerator or any other appliance, unless such is prearranged and paid for to GM at the rate of $75 per item. GM is not responsible for any damage to appliances or to floor, walls, cabinets resulted from such movements. Please insure yourself additionally of incidentals.
If the customer is not ready for the installation for any of the above reasons, following rates will be applied as an additional charge: $125.00 / hour while waiting on the job site, or $250 per additional trip. The installation does not include sink base cabinet adjustment, cutting or framing the cabinets. This work could be done with the rate of $125 per hour, minimum one hour.
The installation does not include cutting the undermount sinks to a "fit to install size", including both, bathroom and kitchen sinks. It's the customer's responsibility not to purchase an oversized sink. The rate of $125.00 / hour will apply for all sink or cabinet cuttings, minimum one hour. Granite Masters is not responsible for sink or cabinet damage during this procedure.
All additional work listed above must be arranged with the main office before it is done. Customer agrees to pay minimum 3 hours ($375), if our installers are solicited or forced to do work that is not listed in this agreement.
VARIATIONS IN GOODS:
As variations of shade, color, and finish are inherent in all-natural products, samples or models are representative only, and the materials installed may not match the samples or models provided by Granite Masters INC or Granite Masters INC agents or suppliers. Because Granite Masters INC is improving or modifying the goods, Granite Masters INC may (1) make minor variations in work, (2) substitute materials or brand name of substantially similar utility or color, or (3) withdraw any product from its current product offering, without consent of Buyer, and Buyer further agrees to accept any substitution. Granite Masters INC calls Buyers attention to the limitation of matching colors, textures, strength, grains, and planes of the following: marble, granite, limestone, travertine, stones, stone products, tiles, flooring, trim, wood, and cabinets. Although Granite Masters INC shall make any effort, when specified to match the existing materials as closely as possible using stock and standard materials, exact duplication is not possible due to naturally occurring variations. Buyer is requested to inspect the granite slabs upon their arrival at Granite Masters INC, regarding color, finish, size, texture, spotting, shading, fissures, veining, and other. Inspection should be done within 48 hours after customer notification. Granite Masters INC is not responsible for any variations as stated above, if customer does not inspect material.
SPECIAL NOTES:
The customer must be present while our installers are working in the customer's home. From time of deposit collection to delivery of fabricated tops is approximately 2-3 weeks. No work will be done on Sundays or legal holidays. The Delivery/Installation receipt must be signed after the job completed. Granite Masters shall not be liable for any loss or direct, incidental, or consequential damages arising due to installation, partial installation or delay in production, deliver, or installation.
TERMS AND CONDITIONS:
Authorization: "You" means the customer set forth on this Customer Agreement and any attached documents (collectively, the "Agreement"). You authorize the Granite Masters to provide the installation of the materials specified in this Agreement (the "Installation").
Installation Information: You acknowledge that installation is limited to the description of work in this Agreement. It does not include any changes to your electrical, gas, or plumbing systems unless specifically noted. You understand that the Installation beginning and completion dates in this agreement are approximate dates and are subject to change. Granite Masters is not responsible for any delays in Installation caused by unavailability of materials, the funding of any home improvement loans, changes or alterations in the work requested by you or required by applicable low, or resulting from incorrect information or measurements supplied by you, your failure to do those things required of you under this agreement, your act of negligence, acts of God, weather, fire, strikes, war, governmental regulations or any causes beyond Granite Masters.
Responsibility of Installer: The installer will complete the Installation in a workmanlike manner with all applicable codes and ordinance. However, the Installer is under no obligation to complete the Installation if it can not be completed in accordance with applicable codes or ordinances. The installer may, at your request, perform additional work to comply with applicable codes and ordinances, subject to the approval of Granite Masters at an additional fee.
Access to Work: You agree to grant the free access of work areas to the Installer, his agents and Employees and any necessary vehicles during normal work hours.
Mechanic's or Material Liens: Granite Masters may have a claim against you for failure to pay for materials supplied or services performed and may enforce this claim by filling a lien against your property after providing you with notice.
Changes: You agree that any changes, additions, or alterations in the Installation may require an additional fee and must be approved by Granite Masters in writing.
Warranty: Granite Masters provides with a one-year limited warranty on the Installation, for jobs paid in full, delivery/installation sheet signed. Granite Masters INC warrants to the owner of a Granite Masters countertop, that Granite Masters INC at its option will repair, without charge, the countertop piece if it fails due to any manufacturing/installation defect by Granite Masters during the first year after initial installation, except for damage caused by chemical (stains) or physical use or abuse. This warranty does not cover countertops that have been moved from their original installed location, and it does not cover the natural characteristics of stone, which include, but are not limited to, color variations, water lines, surface marks, veining, etc. This warranty does not cover damage to your countertop caused by items out of our control, such as house settlement, fires, tornados, and other acts of nature.
Granite Masters INC obligation is limited solely to the repair, including required labor charges of the countertop piece in question.
No implied or expressed warranty of merchantability or fitness for any purpose is covered by this warranty except as expressly stated herein. Granite Masters shall not be liable for any loss or direct, incidental, or consequential damages arising out of the use or inability to use your Granite Masters INC countertop. Costs and Expenses: If the Granite Masters INC incurs any costs or expenses to enforce (to be enforced in the state of IN) any of its rights under this Agreement or to collect any amounts due, you agree to pay Granite Masters INC for all such costs and expenses, including reasonable attorney's fees.
